These Terms and Conditions (“Terms”) govern your use of the McKoy Property Maintenance website and your requests for estimates, appointments, and services. By using this website or submitting information through it, you agree to these Terms.

2. Website Information
Website content is provided for general information and marketing purposes. Descriptions, photographs, starting prices, and other website content do not constitute a binding offer or guarantee.
Submitting an estimate or appointment request does not create a service agreement. Services become binding only after McKoy and the customer accept a written estimate, proposal, work order, or contract.
3. Estimates and Pricing
Unless otherwise stated in writing:
Estimates are based on the information and property conditions available when prepared.
Estimates remain valid for [30] days.
Prices may change if the requested work, property conditions, material costs, or project scope changes.
Additional work requires customer approval and may result in additional charges.
Taxes, permits, disposal charges, specialty materials, and unexpected site conditions may be charged when disclosed in the applicable agreement.
Online or telephone estimates may be preliminary until the property is inspected.
4. Service Agreements
Each project may be subject to a separate written estimate, proposal, work order, or service contract. That agreement will control if it conflicts with these website Terms.
For work governed by the Massachusetts Home Improvement Contractor Law, McKoy will use a written contract containing all legally required terms. Nothing in these Terms waives any non-waivable consumer right.
5. Scheduling and Weather
Service dates and arrival times are estimates unless expressly guaranteed in writing. Landscaping and property-maintenance work may be delayed or rescheduled because of weather, unsafe conditions, equipment failure, supply delays, emergencies, or circumstances outside our reasonable control.
We will make reasonable efforts to notify affected customers and reschedule the work.
6. Customer Responsibilities
The customer agrees to:
Provide accurate contact, property, and service information
Provide safe and reasonable access to the work area
Identify property lines and privately installed irrigation, electrical, drainage, pet-containment, or utility systems
Secure pets and remove fragile or valuable property from the work area
Disclose known hazards, restrictions, permits, condominium rules, or access limitations
Obtain any permission required from an owner, landlord, association, or other authorized party
McKoy is not responsible for damage caused by inaccurate information, concealed conditions, or unmarked privately installed systems, except to the extent responsibility cannot legally be excluded.
Public utility-marking requirements will be followed when applicable.
7. Payments
Payment amounts, deposits, schedules, and accepted methods will be stated in the applicable estimate or contract.
Payments must be made when due. Any late fee, collection cost, returned-payment fee, or interest charge will apply only when disclosed in writing and permitted by law.
For work governed by Massachusetts home-improvement laws, deposits, progress payments, and final payments will comply with applicable legal requirements. Final payment will not be demanded before legally required completion conditions have been satisfied.
8. Cancellations and Rescheduling
Customers should provide at least [24/48] hours’ notice when canceling or rescheduling routine service.
Any cancellation fee will be disclosed before it is charged. Weather-related cancellations initiated by McKoy will not result in a cancellation fee.
When Massachusetts law gives a customer a three-business-day or other statutory cancellation right, that legal right controls over this section.
9. Recurring Services
Recurring lawn or property-maintenance services continue for the period stated in the applicable service agreement. Pricing, frequency, renewal, pausing, and cancellation terms will be disclosed before enrollment.
Either party may end recurring services according to the written service agreement. Amounts already earned for completed work remain due.
10. Results and Property Conditions
Landscaping results may be affected by weather, soil, irrigation, pests, disease, sunlight, customer maintenance, and other conditions outside our control. Unless expressly stated in writing, we do not guarantee that grass, plants, seed, treatments, or other living materials will survive or achieve a specific appearance.
Any written warranty included in a service agreement will control.
11. Photographs
With customer permission, we may photograph completed work for documentation or marketing. We will not intentionally publish identifying personal information without permission.
To decline marketing photographs, contact us before work begins.
12. Website Communications
If you provide your telephone number or email address, you authorize us to respond to your inquiry and send service-related communications.
Marketing texts or emails will be sent only as permitted by law. Consent to marketing messages is not required to purchase services. You may opt out of marketing texts by replying STOP and unsubscribe from marketing emails through the provided link.
13. Website Use
You may not:
Use the website for unlawful or fraudulent purposes
Attempt to access restricted systems or interfere with website security
Submit false, harmful, or misleading information
Copy or commercially exploit website content without permission
Upload malware or other harmful material
We may restrict access when reasonably necessary to protect the website, company, customers, or others.
14. Intellectual Property
The McKoy Property Maintenance name, branding, website design, photographs, text, and graphics are owned by or licensed to McKoy and are protected by applicable law. No rights are granted except the limited right to use the website for its intended purpose.
15. Third-Party Services
Our website may use or link to third-party scheduling, mapping, payment, review, or communication services. Those services operate under their own terms and privacy policies. McKoy is not responsible for third-party systems beyond the extent required by law.
16. Limitation of Liability
To the fullest extent permitted by law, McKoy will not be liable for indirect, incidental, special, or consequential damages arising solely from use of the website.
This limitation does not exclude liability that cannot lawfully be limited, including rights and remedies available under applicable Massachusetts consumer-protection laws.
17. Indemnification
To the extent permitted by law, you agree to be responsible for losses resulting from your unlawful website use, intentional misconduct, or material violation of these Terms. This provision does not require a consumer to waive any right or remedy provided by law.
18. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any dispute not resolved informally will be handled in a court with proper jurisdiction, unless the parties later agree to another lawful resolution process.
19. Privacy
Our collection and use of personal information are described in the McKoy Property Maintenance Privacy Policy, which is incorporated into these Terms by reference.
20. Changes to These Terms
We may update these Terms when our services, website, or legal obligations change. Updated Terms will be posted with a revised effective date. Changes will not retroactively alter an existing signed contract unless both parties lawfully agree otherwise.
